New Milford police arrested a 28-year-old Danbury man Tuesday, April 1 for allegedly breaking into a residence along West Street and assaulting a 55-year-old woman.

Police were called to West Street in the early hours Tuesday when a 911 call indicated a man entered a residence through a window. The man was later identified as Jose Rodriguez.

Rodriguez had a past relationship with an individual who lived in the home but who was not there at the time, police said.

He was confronted by another resident and an altercation took place with that resident, a 55-year-old woman, being choked and assaulted by Rodriguez, police said.

A neighbor came to the assistance of the woman and fought off Rodriguez, who then exited the home. He was later apprehended on West Street and taken into custody, police said.

The woman absorbed minor injuries and was transported to New Milford Hospital, where she was treated and released.

Rodriguez received minor injuries when the neighbor intervened and was also taken to New Milford Hospital, where he was treated and released into police custody.

Rodriguez was being held on $100,000 bond for a court date Wednesday.

He was charged with second-degree criminal trespass, third-degree assault, second-degree strangulation and risk of injury to a minor.
